Description

A mother and daughter discuss sexuality. During their talk, they follow the news concerning Section 377 of the Indian Penal Code (IPC).

For some historical context about Section 377, the law concerns the criminalization of homosexuality. As Buzzfeed News examined in their 2018 article, “India Just Decriminalized Gay Sex“ Section 377 was first enforced over 150 years ago during British colonization. It continued to be in force until the Delhi High Court decriminalized the law in 2009. In 2013, however, due to several years of challenges and protests, India’s Supreme Court reinstated Section 377. FU377 reflects the anger from India’s LGBTQ+’s community about the reinstatement. In 2018, after more hearings, the Supreme Court changed its views and unanimously ruled against Section 377, officially decriminalizing homosexuality in India.

A detailed timeline chronicling Section 377’s protestations and enforcement from a nearly 3 decade period appears in a 2018 article in The Times of India, “‘Gay sex is not a crime,’ says Supreme Court in historic judgement.”
